High court calls for action against erring cops, mining officers

The Punjab and Haryana High Court has directed prosecution and disciplinary proceedings against mining and police officers in "appropriate" cases of gross neglect, unreasonable delay or culpable misconduct in illegal mining matters.

Taking up an illegal mining case, Justice Arun Kumar Tyagi called for prompt action on the complaints by police/mining officers in accordance with law. "In case of gross neglect, unreasonable delay or culpable misconduct on the part of the mining officers or police officers in filing of complaints, registration of FIRs and investigation of the cases, action for their prosecution in appropriate cases be also taken in accordance with law, besides initiation of disciplinary proceedings against them. Appropriate instructions should be also issued in this regard," Justice Tyagi added.

Justice Tyagi also called for making provisions for online complaints on the portal of the department concerned. "It will be appropriate that a provision be made for making complaints by the public with photographs of illegal mining sites and vehicles illegally transporting minerals on the portal," Justice Tyagi added.

Tyagi asserted there was urgent need for creating widespread awareness against undesirable human interference and generating public commitment and support for the cause.

Referring to an affidavit by Director, Punjab Department of Mines and Geology, Justice Tyagi asserted a good number of effective steps had been and were being taken by the government/department for checking illegal mining in the state.

But economic offence of illegal mining, thriving on unlawful enrichment, could be prevented only with public cooperation, participation, commitment and support, he added.
