Punjab and Haryana High Court issues notice to judicial officer

The Punjab and Haryana High Court has put a Haryana judicial officer on notice on a petition alleging that action was initiated against the petitioner-complainant for "daring to stand against a "powerful" officer.

'Misuse of power'

Justice Jaishree Thakur stayed till the next date of hearing proceedings initiated against the petitioner-complainant under Section 182 of the IPC dealing with "false information with intent to cause public servant to use his lawful power to the injury of another person"

The directions came on a petition filed against the state of Punjab and other respondents by Madan Lal through counsel Abhinav Gupta. Going into the background of the matter, Gupta submitted the petitioner, working as a commission agent, had employed his real brother as a manager. Gupta added the petitioner's brother started threatening him in the name of his son, who was a Judge. Whenever the petitioner tried to discuss certain money matter, he would say his son would talk to him. He also started refusing to give the details of accounts to the petitioner.

Gupta added the manager-brother "embezzled lakhs of rupees" and also took money for his use. The petitioner made a complaint dated December 5, 2019, to Sangrur Senior Superintendent of Police (SSP), which was marked to a Deputy Superintendent of Police (DSP). But he requested the SSP to mark the investigation to a senior officer as the accused was a judicial officer.
