Granting regular bail to an SHO allegedly involved in police firing, following the incidents of sacrilege in the state, the Punjab and Haryana High Court today asserted that the statements of witnesses, even if considered true, only indicated his presence without specific allegation of firing or causing injury.

"Even if the entire set of allegations levelled against the petitioner and gathered during the course of investigation are taken to be gospel truth, it would be revealed that it is the mere alleged presence of the petitioner at the time of occurrence having taken place, without being attributed any specific allegation of firing or causing injury to anyone," Justice Sant Parkash asserted.

Senior advocate RS Cheema and Arshdeep Singh Cheema contended the petitioner was serving as SHO of Kotkapura city police station in October 2015, when mass protests were organised at Kotkapura and Behbal Kalan in Faridkot, following incidents of sacrilege.

It was added that the petitioner's implication in the FIR was the result of well-planned conspiracy to keep him in further detention and to wreak vengeance as he had filed a petition and two representations to the DGP regarding manhandling and humiliation caused to him by the investigating agency. — TNS
