Relief for Punjab CM, son; court stays file inspection order

The court of Additional Sessions Judge Atul Kasana today stayed the order granting permission to the Enforcement Directorate (ED) to inspect the income tax case files related to the alleged tax evasion cases pending against Chief Minister Capt Amarinder Singh and his son Raninder Singh.

The ED intended to inspect the files in relation to an investigation pending with them under the Foreign Exchange Management Act. ED officials had claimed before the trial court they wanted to inspect the record for taking the pending investigation to a logical conclusion.

Challenging the order, the CM asserted the ED had no jurisdiction to investigate the matter, which is the subject matter of the complaint pending before the trial court.

The ED had got the order in their favour from the court of Duty Magistrate Jasbeer Singh. The order was passed without notice to the Income Tax Department or to him. Passing such an order without affording an opportunity of being heard was against the principles of natural justice, he had pleaded. The matter will now come up for hearing on October 16. — OC
